This report, produced jointly by the Vance Center and the Central American Federation of Judges for Democracy (FECAJUD), offers an analysis of a compilation of precedents regarding precautionary measures granted to judges by the Inter-American Commission on Human Rights (IACHR). Drawing from a range of cases and precedents, this report aims to delineate the IACHR’s current standards for precautionary measures, focusing particularly on instances when criteria related to judicial independence were evaluated.
The report also seeks to present arguments advocating for expanding the IACHR’s criteria on this issue, supported by a comprehensive rationale grounded in legal precedents, human rights principles, and the pragmatic imperatives of ensuring judicial independence and safety.
We are grateful to international law firm White & Case for its support in preparing this document. The report is also available in Spanish.
