The Vance Center Supports Guatemalan Judge Erika Aifán

As part of the Vance Center’s longtime support for judicial independence and integrity in Guatemala, including on behalf of the Guatemalan Association of Judges for Integrity, co-counsel Professor Doug Cassel of King & Spalding and the Vance Center undertook to represent Guatemalan Judge Erika Aifán in seeking redress before the Inter-American Human Rights System.
Judge Aifan has faced a series of threats and attacks on her judicial independence and personal safety, as the Inter-American Commission on Human Rights recognized by granting her precautionary measures since October 2019. However, baseless criminal and administrative complaints and threats to lift her procedural immunity for her decisions in high-profile cases have persisted.
Judge Aifán is a trial judge presiding over the High-Risk Criminal Court “D” with responsibility for high-impact crimes, particularly high-level corruption and organized crime cases. She received the U.S. State Department’s 2021 Women of Courage Award and is a member of the Guatemalan Association of Judges for Integrity.
Judge Aifán is a graduate of the San Carlos University School of Law, has a master’s degree in financial administration from the University of San Carlos in Guatemala, a master’s degree in labor law and social development in Europe from the University of Castilla La Mancha in Spain, and a doctorate in criminal sciences from the University of San Carlos in Guatemala. She has participated in the Vance Center’s activities to strengthen judicial independence in Guatemala and Mexico.
Professor Cassel is an expert in international human rights law and the jurisprudence and procedures of the Inter-American Human Rights System. As counsel to King & Spalding, he has provided the Vance Center with critical assistance on several occasions and, for this, received the Vance Center’s special recognition for international pro bono excellence in October 2020 when his firm also received recognition for its work on behalf of the Lawyers for Reporters initiative. He recently brought a case before the Inter-American Commission on Human Rights with the help of the Vance Center for Canal 12, Nicaragua‘s only nationwide television broadcaster.

Como parte del permanente apoyo del Vance Center a la independencia e integridad judicial en Guatemala, incluyendo a la Asociación Guatemalteca de Jueces por la Integridad, el abogado profesor Doug Cassel de King & Spalding y el Vance Center se comprometieron a representar a la jueza guatemalteca Erika Aifán ante el Sistema Interamericano de Derechos Humanos.
La jueza Aifan ha enfrentado una serie de amenazas y agresiones a su independencia judicial y seguridad personal, tal como lo reconoció la Comisión Interamericana de Derechos Humanos al otorgarle medidas cautelares desde octubre de 2019. Sin embargo, han continuado las denuncias penales y administrativas infundadas y solicitudes de antejuicio por sus decisiones independientes en casos de alto perfil.
La jueza Aifán es una jueza de primera instancia que preside el Juzgado de Mayor Riesgo “D” con responsabilidad en delitos de alto impacto, en particular casos de corrupción de alto nivel y crimen organizado. Recibió el premio Mujeres de Coraje 2021 del Departamento de Estado de EE. UU. y es integrante de la Asociación Guatemalteca de Jueces por la Integridad.
La jueza Aifán es egresada de la Facultad de Derecho de la Universidad de San Carlos, tiene una maestría en administración financiera de la Universidad de San Carlos en Guatemala, una maestría en derecho laboral y desarrollo social en Europa de la Universidad de Castilla La Mancha en España y un doctorado en ciencias criminales por la Universidad de San Carlos en Guatemala. Ha participado en actividades del Vance Center para fortalecer la independencia judicial en Guatemala y México.
El profesor Cassel es experto en derecho internacional de los derechos humanos y en la jurisprudencia y procedimientos del Sistema Interamericano de Derechos Humanos. Como asesor legal de King & Spalding, ha brindado asistencia crítica al Vance Center en varias ocasiones y, por ello, recibió el reconocimiento especial del Vance Center a la excelencia internacional pro bono en octubre de 2020 cuando su firma también recibió el reconocimiento por su trabajo en nombre de la iniciativa “Abogados para Reporteros”. Recientemente, presentó un caso ante la Comisión Interamericana de Derechos Humanos con la ayuda del Vance Center para el Canal 12, la única emisora de televisión nacional de Nicaragua.
